At OhPadel (Pty) Ltd (Registration Number: 2024/242713/07) (the “Company”, “we”, “us”, “our”), we value your privacy and the importance of safeguarding your personal information, as defined in the POPIA (“personal information”). This Privacy Policy (the “Policy”) describes our privacy practices for the activities set out below. In this Policy, personal information refers to any information that on its own, or in combination with other available information, can identify an individual or juristic person and has the meaning as defined in the Protection of Personal Information Act 4 of 2013 (“POPIA”).

2.1. When you make a purchase, or attempt to make a purchase, we collect the following types of personal information:

How we collect your personal information
2.3. You may give us your account information, financial information, demographic information and contact details by filling in forms, using our Services, entering information online or by corresponding with us by
phone, email or otherwise.
2.4. This includes personal information you provide when you:
2.4.1. Create an account or purchase products on our website;
2.4.2. Use our Services or buy our products from the Pro Shop;
2.4.3. Express interest in our Services;
2.4.4. Download software and/or our mobile application;
2.4.5. Subscribe to our newsletter;

2.4.6. Complete a voluntary market research survey;
2.4.7. Contact us with an inquiry or to report a problem (by phone, email, social media, or messaging service); and/or
2.4.8. Log in to our website via social media.
2.5. If you provide us, or our service providers, with any personal information relating to other persons, you represent that you have the authority to do so and acknowledge that it will be used in accordance with this Policy.
2.6. If you believe that your personal information has been provided to us improperly, or to otherwise exercise your rights relating to your personal information, please contact our Information Officer using the contact details below.
3. PURPOSES
We collect and use your personal information with your consent to provide, maintain,
and develop our Services and understand how to improve them. These purposes
include:
3.1. Providing the Services;
3.2. Complying with applicable laws;
3.3. Building a safe environment at the Clubs;
3.4. To verify or authenticate your identity;
3.5. To process payments;
3.6. Investigate and prevent security incidents such as attacks and hacks;
3.7. Improving the Services;
3.8. Enable you to access our Services;
3.9. Providing you with technical and customer support;
3.10. Sending you newsletters and other marketing communications about current and future products, programs and services, events, competitions, surveys and promotions held by us or hosted on our behalf; and
3.11. Organizing events or registering attendees and scheduling meetings for events.
4. TRANSFER OF PERSONAL INFORMATION
4.1. Where possible, we store and process data on servers within the geographical region where you reside. Your personal information may also be transferred to, and maintained on, servers residing outside of the Republic of South Africa, where the data laws may differ.
4.2. We will transfer your personal information outside of South Africa only where it is treated securely and in accordance with legislation that is similar to the POPIA.
4.3. We may disclose your personal information in order to comply with a legal obligation. Where possible and practical to do so, we will tell you in advance of such disclosure.
4.4. We may use a third party service provider, independent contractors, agencies, or consultants to deliver and help us improve our Services. We may share your personal information with such third-parties but only to maintain and improve our Services.
5. RETENTION AND DELETION
We will only retain your personal information for as long as necessary for the purpose for which it was collected and to the extent required by applicable law. When we no longer need your personal information, we will remove it from our
systems and/or take steps to anonymize it.
6. SECURITY MEASURES
6.1. We have appropriate organizational safeguards and security measures in place to protect your personal information.
6.2. We secure the integrity and confidentiality of your personal information in our possession or under our control by taking appropriate, reasonable technical and organisational measures to prevent loss of, damage to or unauthorised destruction of personal information; and unlawful access to or processing of personal information.
6.3. In order to implement and maintain such measures, we have in place policies, controls and related processes, which are reviewed and updated on a regular basis. Our policies, controls and procedures cover for example:
6.3.1. physical, technical and network security.
6.3.2. access controls and monitoring of access.
6.3.3. secure storage, destruction and encryption of records of personal information.
6.4. We require any third party who is contracted to process your personal information on our behalf to have security measures in place to protect your data and to treat such data in accordance with applicable law.
6.5. In the unfortunate event of a personal information breach, we will notify vou
and the Information Regulator.

7. YOUR RIGHTS
7.1. You have the right to request a copy of the personal information that we are processing about you.
7.2. You have the right to have incomplete or inaccurate personal information that we process about you rectified.
7.3. You have the right to request a list of third-parties that have access to your personal information in terms of the Services.
7.4. You have the right to request that we delete personal information that we process about you, unless we need to retain such data in order to comply with a legal obligation or to establish, exercise or defend legal claims. You will no longer be able to access the Services in the event of such deletion
of personal information.
7.5. You have the right to obtain personal information we hold about you, in a structured, electronic format.
7.6. Where the legal justification for our processing of your personal information is our legitimate interest, you have the right to object to such processing on grounds relating to your particular situation. We will abide by your request
unless we have compelling legitimate grounds for processing which override your interests and rights, or if we need to continue to process the personal information for the establishment, exercise or defence of a legal claim.
7.7. You can make a request to exercise any of these rights by sending the request to our Information Officer. For your own privacy and security, at our discretion, we may require you to prove your identity before providing the requested information.
7.8. You have the right to lodge a complaint with the Information Regulator in the event that you have a complaint about this Policy or our compliance with the POPIA. You can lodge a complaint on this website: https://inforegulator.org.za/
